Man pastes daughter's face to ordinary pornography pictures and goes free

In 2008, Joseph Lowell Gerber (age 38) from Milipitas, California was charged with:

1. possession of child pornography (for pasting pictures of his 13 year old daughter's face on ordinary pornography pictures),
2. annoying or molesting a child
3. furnishing Marijuana to a minor under 14 years of age
4. 2 counts of furnishing a controlled substance to a minor

The victim? His very own 13 year old daughter.

At the time of the trail, Gerber was accused of:

1. providing his daughter with alcohol
2. providing his daughter with Cocaine
3. providing his daughter with Marijuana
4. suspected provision of Methamphetamine

Even though the 13 year old (14 at the time of the trial), made all these accusations, she says that they were used to coerce once she had formed an addiction. He would take pictures of her wearing her bra and panties and he would then give her more Cocaine.

According to documents from the 6th District Court of Appeals in San Jose, Gerber admitted to taking pictures of his daughter for lengths of up to twenty minutes per session and then gave her drugs as a barter for their agreement. Gerber used this as an excuse that she was consensual, I assume. Even though this sickening excuse for a human being admitted masturbating to the photos and having "sick thoughts".

There was a law intended to put a halt to the exploitation of children by pedophiles such as Gerber. Broad interpretation to apply to computer-alleged photos may violate U.S. Constitutional Standards. The US Supreme Court established in 2002 when a strike down ona federal law "virtual child pornography", sexually explicit photos that were entirely computer generated.

Even though humanity as a whole finds these images and behaviors to be unattractive, the possession of the altered photos is protected by the 1st Amendment. The ruling in the case was 3-0.

How can you spot a pedophile? It's not easy. Imagine being married to one and sending your daughter off to spend the Summer with her father and while she is there she gets strung out on drugs and her sexual innocence has been tainted.

Pedophiles are:

• normally male
• mean of age is 27, ages of all others ranging from 14-58
• majority Caucasian
• little formal education
• grew up in a Christian home
• isolation a major issue
